As per the Bylaw of Legal Immigrant Association (“LIA), the national
grassroots organization of U.S.-educated professional immigrants will hold its
annual Board of Directors election in December 2009. According to the Bylaw,
only registered members will be eligible to vote in the upcoming election. We
welcome our supporters to join LIA by registering at LIA’s official website (www.legalimmigrant.org ). If you have not registered for LIA membership
but have donated at least $20 since Jan 1, 2009, please send an email to election@legalimmigrant.org and
confirm that you wish to be registered. We will register LIA membership for
you. Please include your name, home address, email address, and phone number.
As per the LIA Bylaw, the incumbent Board of Directors has nominated
volunteers who have made significant contributions to the cause of advocating
for the legal rights of professional Chinese immigrants as candidates for the
new Board. Eligible voters will select five members to the new Board of
Directors. Personal statements of all candidates will be sent to eligible
voters by email along with instructions on how to vote. Due to the Christmas
holiday, eligible voters will be able to vote from Dec 19 to Dec 28, 2009.
The tenure of the new Board of Directors will be from Jan 1, 2010 to
Dec 31, 2010.

游说项目。需要说明的是项目筹得的资金和项目计划完全由EB3C委员会全权决定,专款专用,LIA理事会不干预。
现在,LIA
参与的EB3
诉讼项目也采用同样的管理办法,资金和方案完全有诉讼委员会全权决定,专款专用。
LIA的绝大部分支出是用在游说上,包括07年的name
check,08年的STEM,recapture
和H1B
multifiling investigation,09年的485透明度,140延迟,和ACT
NOW。
在name
check上,LIA的游说帮助了移民局得到国会两千万的拨款。 在multifiling
调查上,LIA促成了移民局在08年末产生的报告,指出约20%的H1B申请是
multifiling,促使移民局加强了监管。
STEM和recapture
两个法案在08年上半年势头很好。LIA的代表作为唯一的申请人在6月初的听证会上作证。Recapture在移民委员会以8:1绝对优势通过。但是下半年因为经济形势急转直下,两个法案全部搁浅。
从08年下半年开始,LIA制定了更容易实现的游说目标,把目标定在移民局上。LIA先后通过lobbyist和移民局进行了两次专门会议,解决485库存和140延迟案件透明度的问题,都取得了明显的成效。
同其他组织一起,LIA
促使移民局做出了4个月处理140的承诺。对于个别被滞后的案件,LIA同移民局达成协议,帮助LIA会员进行个案查询。LIA从8月以来共收到5个会员的查询,140被拖延9个月以上。经过LIA
140查询系统,全部在6周内得到批准或RFE。

经过自己的努力,促使移民局在9月23日公布了485
库存数据,部分消除了移民局的黑箱操作,使申请人能够看到自己的排队位置。并给VB游说排期提供了数据基础。
经过lobbyist游说,ACT
NOW
法案已经成功在众参两院被推出,并已经被众参两院的移民委员会主席加入到他们的CIR中。如果10年上半年CIR失败,LIA将推动ACT
NOW
作为独立法案通过。
LIA的游说策略还不成熟,有很多需要改进的地方,特别是在现在经济形势下,不能为职业移民增加名额。不仅我们不能,更强大的组织,包括Compete
America和IV,也不能。但是这并不能否定我们在其他方面取得的成绩。比较其他民间移民组织,LIA的工作成绩是突出的,如485库存透明,推出ACT
NOW,解决140延迟等等。同时,我们也积极参与有可行性的诉讼,如这次将中国EB3在过去两年中的短缺追回来。去年针对中印两国EB2排期的不均衡,LIA曾经做了大量的努力,雇用律师做立案分析。但是最终因为没有法律立足点而搁浅。

Robert Divine wrote an analysis about USCIS-published 485 inventory. It points
out that the inventory data is not comprehensive because it doesn't include
pending 485 cases from consulate and cases whose cut-off dates are not current
thus can't file 485. Please refer to the report for details. |

LIA EB3 游说项目组 2010年10月18日 附录:Summary from Bruce Morrison regarding EB3 lobby and litigation The visa under usages in 2008 and 2009 occurred when we were not retained by LIA. We warned that monitoring of monthly results was required, but the group apparently did not have the resources to retain us. We began this project a year ago to press for the maximum possible China EB-3 numbers that we could achieve. Even before the project began, I had spent the summer of 2009 pressing Mr. Oppenheim about the severe shortfall in China EB-3s for 2009 and the reasons for it. Early in our project I raised the issue of family fall across and that many China family numbers had gone unused in 2009. That was the crucial fact that moved Mr. Oppenheim to move China to ROW and to keep it there for the bulk of the year. As the end of the year approached, he was worried about how far over its allocation China was (with the CSPA 300 deduction). Although I pressed him to stay at ROW, he indicated that the FB usage appeared to be very high and he feared that he would not cover the extra EB numbers. In the end, I was right and the extra numbers were fully covered. However, Mr. Oppenheim continues to resist my arguments for an internal EB fall down regime that would provide even more numbers to EB-3 because they are “not needed” for EB-5, EB-1 or EB-2. Moving him on this analysis would be a primary focus of 2011 work. The lawsuit had nothing to do with our numbers in 2010. The suit began after most of the extra numbers were already allocated. And the suit was not considered by the judge till the last week of the fiscal year. And the decision was reserved, so there has been no pressure on Mr. Oppenheim from the lawsuit. However, there is no doubt that the suit made lobbying harder, because Mr. Oppenheim resented the fact that his actions were being questioned in this way. I warned of that effect from the beginning. However, if the suit is successful, it will be worth it. For that reason, I have actively helped Bob Pauw from the beginning. I consulted with him about how the visa allocation system works. He did not have nearly the knowledge that I have about the system. But he is a very good lawyer and he has presented a good case. The challenge is to accelerate the use of numbers for pending cases, not to take numbers from one group of Chinese immigrants to give to another group. I developed a theory of “equitable reallocation” that would move the cut-off dates ahead to readjust the allocation between China and other countries to reflect the improper hold-back of the cut-off in 200 and 2009. This would allow the per-country limit to be exceeded in 2011 to allow for reallocation. Bob also has presented a “recapture” theory—giving more per-country numbers to China in 2011 that it was denied in 2008 and 2009. However, since there were no extra overall EB numbers in those years, the numbers would come from long ago and I am skeptical about whether the court can recapture them in this way. In addition to monitoring the visa allocations and providing lobbying arguments that were successful in increasing the overall numbers, I was able to make big progress on transparency at both DHS and USCIS. It was our lobbying that led to the creation of the I-485 inventory. And I used that to get Mr. Oppenheim to provide the pending demand reports that he now publishes each month. We have dramatically changed the quality of information to predict and advocate cut-off date movement. The next steps are the integration of field office cases into the I-485 inventory and the creation of an approved I-140 inventory to predict future demand. I have moved both of these projects forward this month in anticipation of a contract extension. In the future, monitoring of FB usage will also become important to push for fall across usage. And there are still arguments for better use of fall down and fall across numbers to enhance the annual totals available to EB-3. China is starting behind the ROW cut-off for 2011. It will stay there unless there is forceful lobbying to move it up. The lawsuit is about 2008 and 2009 and has nothing to say about that—and could result in China numbers from 2011 being reduced to handle 2008 and 2009, rather than adding to the total.

用2008年全年(图三)的减去2800个中国EB2配额可以看出,去年中国从全世界多分了4164名额,同时我们也可以从图二看到,截至2008年6月30日,全世界共用去132832个名额,然而今年同期全世界仅用去110871个名额,少用 了21961个名额。经济不景气造成的移民锐减 已经一目了然。我们有理由相信,今年全世界会有更多的剩余名额, 导致移民排期迅速前进。(注意,08年职业移民获得family 2万多未用名额,09年则难以得到family未用名额)具体数据将会最快在2009年10月中旬出炉。我们认为,这批数据的出炉将会大大提高USCIS工作的透明度,从而使我们能够迅速预判排期的进度。如果我们的预测与实际有误,也可以通过政治说客来提醒USCIS来加以改变。由于这种工作属于行政监督,而非立法改革,所以可行性强,见效快。
当前,LIA EB2 小组先公布此移民数据,以供LIA会员参考使用。接下来,我们将很快与游说顾问接触,咨询游说顾问是否有可能依靠他们来监督移民局对剩余数据的使用和所需费用。

Applicants can more reliably estimate their expected waiting time for green cards and thus, finally make informed life decisions in career development, family, and becoming new Americans. Congratulations to USCIS, particularly Deputy Chief of Service Center Operations Robert Kruszka and his team, for working with stakeholders including the Legal Immigrant Association in particular and recognizing the importance of making this inventory public."

For more than two years, LIA has closely followed both State Department and USCIS immigration activities through our Washington representatives, Morrison Public Affairs Group. This has led not only to the discovery of a law that discriminates against Chinese based on national origin (for which we have a legislative solution: the ACT Now bill introduced in both the House and Senate), but also to significant progress clarifying the processing of I-485s.
Last October, in one of a series of meetings arranged by our Washington representatives, LIA became the first – in fact, the only – organization to request that USCIS release what we suggested they call an “inventory” of I-485 data. Early this year, LIA made the “inventory” disclosure as its top agenda. Throughout 2009, both through our Washington representatives and in direct meetings with LIA’s dedicated team, USCIS continued to promise that an inventory of I-485 data – something like the monthly Visa Bulletin issued by the US Department of State – would be made available online. More details of the progress can be found in LIA newsletter.
On September 23rd, USCIS has for the first time published an inventory of I-485 data online. LIA was the only group to be notified of the release date. Through this LIA-urged innovation, applicants can more reliably estimate their expected waiting time for green cards and thus, finally make informed decisions in career development, starting a family, and becoming new Americans. This USCIS initiative, prompted by LIA’s tireless advocacy, is an important step to improve the transparency of USCIS in providing immigration benefits.
LIA’s leadership, and all of our growing membership congratulates our team that kept up the pressure and got this done – and we thank USCIS, particularly Robert Kruszka and his Service Center Operations team for listening to our ideas, and recognizing the importance of making this inventory public.
This kind of positive result depends on YOU – the involvement of LIA’s members, and the constant growth in our membership: we are still a new, grassroots group, but with your continued help and support we can keep working hard and effectively to make the immigration system work the way it should.

移民局的网站在9月21日全面更新,但是并没有提供485库存数据的查询。有不少会员向我们询问此事。22日,LIA及时和移民局官员取得了联系,得到的回复是:没有及时发布库存数据是因为数据库的技术故障,而不是政策变化。他们表示将在“非常短的时间”发布该数据库。保守的估计,这段时间可能是几天,甚至几周。移民局早在6月中旬就表示要发布数据,后来推迟到7月,8月,直到9月底。所以,我们只能希望大家耐心等待。
LIA对21日发布的过于乐观的消息表示歉意。

移民局网站9月22日将全面更新,并提供485库存数据查询。
LIA 9月21日得到移民局的确认:移民局将在9月22日推出全新的网站(www.uscis.gov)。改进后的网站将更直观、方便。更重要的是,改进后的网站将提供对未被批准(库存)的485申请数量的查询。通过查询,申请人就可以知道自己在等待队列中所处的位置。
