USCIS Responds to Steady LIA Involvement -- I-485 Inventory Data Released September 23, 2009

For more than two years, LIA has closely followed both State Department and USCIS immigration activities through our Washington representatives, Morrison Public Affairs Group. This has led not only to the discovery of a law that discriminates against Chinese based on national origin (for which we have a legislative solution: the ACT Now bill introduced in both the House and Senate), but also to significant progress clarifying the processing of I-485s.

Last October, in one of a series of meetings arranged by our Washington representatives, LIA became the first – in fact, the only – organization to request that USCIS release what we suggested they call an “inventory” of I-485 data.  Early this year, LIA made the “inventory” disclosure as
its top agenda. Throughout 2009, both through our Washington representatives and in direct meetings with LIA’s dedicated team, USCIS continued to promise that an inventory of I-485 data – something like the monthly Visa Bulletin issued by the US Department of State – would be made available online. On September 23rd, USCIS has for the first time published an inventory of I-485 data online.
LIA was the only group to be notified of the release date. Through this LIA-urged innovation, applicants can more reliably estimate their expected waiting time for green cards and thus, finally make informed decisions in career development, starting a family, and becoming new Americans. This USCIS initiative, prompted by LIA’s tireless advocacy, is an important step to improve the transparency of USCIS in providing immigration benefits.

LIA’s leadership, and all of our growing membership congratulates our team that kept up the pressure and got this done – and we thank USCIS, particularly Robert Kruszka and his Service Center Operations team for listening to our ideas, and recognizing the importance of making this inventory public.

LIA不懈努力终获回报,移民局公布职业移民绿卡申请积压数据

2009923日,移民局(USCIS)首次在其网站公布职业移民(EB)I-485调整身份申请的待处理的积压数据。这是合法移民协会(Legal Immigrant Association, 简称“LIA)继发现歧视中国移民的法律条款并推动在美国国会参众两院提出“立即接收中国人才法案”(Accept Chinese Talent Now, 简称“ACT Now)之后,独立推动并实现的又一重要成果。申请人能根据该数据预计自己拿到绿卡的时间并做出合理的职业发展计划。它不仅使正在饱受绿卡排期煎熬的中国EB类申请人受益,而且惠及来自其他国家的EB类申请人。

 

去年10月,在其雇用的游说顾问的安排下,LIA的代表与移民局高层官员举行首次独家会议。会上,LIA向移民局提出要求其公布按国家,类别和优先日期列出的职业移民I-485调整身份申请的待处理的积压数据(LIA建议移民局称其为“inventory data", 即“库存数据”). LIA从而成为第一个,也是唯一一个向移民局提出此项要求的组织。此后,LIA及其游说顾问不断催促移民局尽快落实此项目。今年2月,LIA把移民局公开“库存数据”做为今年的。今年5月,LIA代表与移民局高层官员再次会晤,并将公布I-485待处理数据列为首要议题。会上,移民局官员承诺将尽快在其网站公布I-485数据。详请请见LIA Newsletters.

 

在此后的几个月中,LIA及其游说顾问一直在密切跟踪此项目的进展情况。8月底,移民局向LIA,也仅向LIA,透露,“库存数据”移民局于922日和改进后的网站同时发布。由于技术故障,数据推迟了一天在23日出台,立即引起了广泛的兴趣。据此,申请人将能比较准确的预测其等待绿卡的时间,从而为自己的职业发展及家庭作出规划。这项经过LIA的不懈努力而推动实现的移民局首创项目,是改进移民局在提供移民服务方面的透明度的重要一步。

 

LIA理事会及全体会员祝贺其团队坚持不懈,从而使此惠及中国及其他国家的EB类绿卡申请人的项目得以实现。LIA感谢移民局听取LIA的意见,能认识到公布I-485库存数据的重要性。作为一个新生的全国性草根组织,LIA为职业移民奔走呼号,取得了积极的成果。希望来自中国的职业移民及华人社区继续支持LIA的努力,推动移民立法及行政改革。
